GENERAL CONDITIONS OF SALE

The present conditions of sale are valid between the Company GAIATREND SARL with stated capital assets of 60 000 euros of which the head office is situated at 10 route de Strasbourg 57410 ROHRBACH LES BITCHE registered as a commerce of the SARREGUEMINES Companies under the number 504 762 022 00011 hereafter named "GAIATREND" and by any or all persons wishing to proceed with the purchase of an item or items through the website of "GAIATREND" hereafter named as the "buyer"

1. Object

The present conditions of sale aim to define the contractual obligations between GAIATREND and the buyer and the applicable conditions to all purchases made through the website www.alfacig.com of GAIATREND, whether the buyer be a professional entity or consumer.

GAIATREND reserves the right to modify the conditions of sale at any time. In this case the applicable conditions will be those current on the date of purchase by the buyer.

2. Characteristics of goods proposed

The products presented are those that are featured on the website of GAIATREND. They are sold up to the limit of available stocks.

The catalogue photographs are as representative as possible but cannot be exactly the same as the product sold, especially concerning the colours.

3. Tariffs

The prices quoted on the website are the total prices in euros including VAT at the applicable rate on the purchase date, all changes in the rate of tax will be reflected in the price of the products.

GAIATREND reserves the right to modify the prices at any time although the price shown on the website on the order date will be the only price applicable to the buyer.

The prices indicated do not include transport and delivery costs.

4. Orders

A client who wishes to make a purchase must:

- provide all the identification details requested or give their client number if applicable;

- complete the order form online giving all references of the products required;

- validate their order after verification;

- make the payment according to stated conditions;

- confirm their order and payment.

The order confirmation shall act as acceptance of the present conditions of sale and the recognition of having read and understood said conditions.

All information provided by the buyer and their confirmation online shall be proof of the transaction. The confirmation shall act as their signature and acceptance of all stated conditions and operations undergone.

The seller will communicate by email the acceptance and confirmation of the buyers order.

5. Retractation

The buyers, physical persons that are non professional entities, benefit from a seven day retraction period beginning on the date of delivery of their order. During this time they may return their product to the seller for exchange or reimbursement without penalties but non inclusive of the return delivery costs.

Only products that are returned complete with original packaging and in a perfect state for resale will be accepted for exchange or reimbursement. All products that are damaged in any way or have their original packaging damaged or incomplete in any way will not be reimbursed nor exchanged.

6. Methods of payment

The prices are payable at the time of ordering.

Payments will be made by credit card. They will be made through the secure system CM-CIC p@iement which uses the SSL (Secure Socket Layer) protocol by which system transmitted information is encrypted by software and no third party can gain admission to the information during its time on the network.

All orders will only be prepared after confirmation of payment.

At the buyers request a paper invoice can be sent showing the VAT paid on the purchases.

7. Deliveries

Deliveries will be made to the address indicated on the order form.

Any risks are undertaken by the buyer from the moment that the products leave the GAIATREND premises. In case of damage during transport it is very important to note any delivery or damage problems on the delivery note before accepting said delivery. A claim should then be lodged with the transporter within three days from the date of delivery. This claim should be sent by registered post with notice of reception.

The exchange of any product not declared as damaged at the time of delivery will not be possible.

The dates of delivery given at the time of order are only estimated and given as a general indication. If the delivery period exceeds thirty days from the date of order then the sales contract will be declared null and void and a reimbursement made to the buyer.

8. Guarantee

All products furnished by the seller benefit from a legal guarantee as per articles 1641 of the French Civil Code.

The duration of the guarantee is one year for the electric system and electrical accessories and three months for the batteries. Consumables such as the vaporiser and cartridges are excluded from the guarantee. Also excluded are any parts or products modified, changed or repaired by the client or another person or entity not elected or authorised by GAIATREND.

9. Responsibility

The seller, during the process of sales can be held responsible only for the products themselves, their responsibility does not cover problems due to the use of the internet such as loss of data, intrusion, viruses, rupture of service or other involuntary services.

GAIATREND can not be held responsible for any damages whatsoever, either material, immaterial or corporal which could result from the malfunction or misuse of the products. The same applies for modifications made to said products.

The responsibility of GAIATREND will, in any case, be limited only to the fiscal amount of the order and they will not be blamed for any simple errors or omissions that may arise despite the extreme precautions taken in the presentation of the products.

10. Delivery errors

All mistakes in delivery or non conformity should be notified the first working day following delivery at the latest. Beyond this date any claims will be rejected. Any claims should be sent by email ( contact@alfacig.com) or by telephone (03 87 02 85 67).

11. Intellectual property

All elements of the website of GAIATREND remain the intellectual and exclusive property of GAIATREND.

No person or entity is authorised to reproduce, exploit, redistribute or use in any way, even partially, any part of the website whether it be software, textual, visual or audio.

All links, either simple or hypertext, are strictly forbidden without express written agreement by GAIATREND.

12. Personal Information

According to the law of 6 January 1978 relative to information technology, files and liberty, all recorded information relative to purchasers may be treated automatically.

The buyers retain the right of access and rectification to information concerning themselves in accordance with the law of 6 January 1978. GAIATREND also agrees not to communicate said client information to any third party either free or with payment.

The automatic treatment of information, including the management of site users email addresses, is subject to a declaration of the CNIL of the 18 March 2009 registered under number 1352726.

13. Filing - Proof

GAIATREND files all orders and invoices on a secure and durable support which constitutes faithful copies of such as per the instructions according to article 1348 of the French Civil Code.

The information registered by GAIATREND will be considered by all parties to be proof of all communications, orders, payments and transactions between the parties concerned.
